Effective January 1, 2017, the California Secretary of State’s office will begin issuing a single apostille regardless of the destination country.  Another words, an apostille will be issued for all countries.

Prior to January 1, 2017, the State of California would issue an apostille for countries who are members of the Hague Apostille Convention and a gold seal certificate for non-member countries.

Apostille Certificate of Good Standing

Do you need an Apostille on a Certificate of Good Standing?

If you are planning to expand your business to another country, you will be required to prove that your company is in good standing with the State of California.  In California, the Articles of Incorporation can be used to demonstrate that you have an active and valid business in the State of California.

The California Secretary of State has a website where you can search for active corporations in the State of California.  Some companies have printed-out the information in addition to the Articles of Incorporation.

In order to have an apostille attached to your Articles of Incorporation, you will need to mail-in a certified copy stamped by the California Secretary of State.  The State will typically stamp the back of the certificate with a blue/purple seal which will include the signature of the Secretary of State.

Black and white copies or not acceptable and will be rejected by the State.  The best method to obtain new certified copies is to contact the California Secretary of State’s office for assistants.  You may be able to order new certified copies online have it delivered to you quickly.  There are also service companies located in Sacramento that can help expedite the process.

Apostille Power of Attorney

Do you need to provide a Power of Attorney to someone in another country to conduct business on your behalf?  Every month we apostille over 100 power of attorney documents.  There are over 100 countries who are members of the Hague Apostille Convention.  The most common countries who request an apostille on a power of attorney are: Mexico, India, Spain, Italy, Russia, Ukraine, Poland, …

In the State of California, a Power of Attorney can be written in any language.  This means that you do not need to translate your documents to English.  It’s important that the notary notarizes the documents correctly in order to avoid any delays.  You can request the assistants of an attorney in the other country to help draft your power of attorney.  An ideal power of attorney will have both English and the other language on the document divided vertically through the center.

In order for the document to be accepted by the State of California, the notarial wording must be written in English and either be included at the end of the Power of Attorney or attached to the signed page (California Acknowledgment).  When choosing a notary, it’s important to find one with at least 3 years of experience and one who will follow the notarial laws of the State of California

About 60%-70% of notarized documents we receive at our office are rejected by the State of California.  Here is a list of common notarial mistakes:

1. The notary forgetting to write “Notary Public” after their name.
2. The notary forgetting to include their seal and signature.
3. Incorrect notarial wording on the page.
4. The signature of the signer is missing.
5. The signature of the notary doesn’t match.

The least experiences notaries are found at Banks and credit unions.  We recommend that you work with a notary who has at least 3 years of experience.  It’s important to let the notary know that the notarial seal, signature, and notarial wording will be authenticated by the California Secretary of State.  If their are any mistakes, the documents will need to be redone costing you time and money.

Apostille Orange County California

Do you need an apostille in Orange County, California?

Orange County is the third most populous county in California.  Many of your clients in the area prefer to mail-in their documents to our Los Angeles (Burbank, CA) office for fast same-day processing.  Even though there are 34 cities in Orange County and a population of over 3 million, the California Secretary of State does not have an office in the area.

If you are located in the areas of Santa Ana, Anaheim, Costa Mesa, Newport Beach, or Irvine, it doesn’t make sense to drive all the way to Downtown Los Angeles to have your documents authenticated by the State of California.  If you take into consideration the drive (Your time, gas, wear and tear on the vehicle), cost for parking, state fees, 2-3 hour wait, and the drive home, you can spend 4-6 hours trying to authenticate one document.  Also, mailing-in your documents to the Sacramento Secretary of State can take over three weeks for an answer.

Apostille San Diego California

Several years ago, the California Secretary of State closed their San Diego office leaving many business in the area without any means to apostille documents quickly.  This unforeseen measure was to help the State of California save money during the great recession.

The closest state office to San Diego is the California Secretary of State’s office in Los Angeles.

Need an Apostille in California?

We are experts in providing California State Authentication of documents sent to countries who are members of the Hague Apostille Convention.  The destination country determines if your document will receive an Apostille or Certification.

What is a California Apostille?

An Apostille or certification basically authenticates the signature of the official who signed the document.  The California Secretary of State provides authentication of public official signatures on documents to be used outside the United States of America.

For example, India is a member of the Apostille convention. If presented with a document that requires authentication by the California Secretary of State, then an Apostille will be attached. China is not a member of the Apostille convention and thus will only be issued a Certification. You can view a list of member countries by visiting this link: Apostille Member Countries.

The Apostille, which contains a stamped red seal, is attached to your original signed document to verify it is legitimate and authentic so that it will be accepted in the other country.

Sample California ApostilleThe Apostille Convention requires that all Apostille’s be numbered consecutively, with individual numbers applied to each Apostille issued. The recognized standard Apostille contains a seal and 10 mandatory references: name of country from which the document emanates, name of person signing the document, the capacity in which the person signing the document has acted, in the case of unsigned documents, the name of the authority that has affixed the seal or stamp, place of certification date of certification, the authority issuing the certificate, number of certificate, seal or stamp of authority issuing certificate and signature of authority issuing certificate.

The California Certification actually looks more official than the Apostille. For example, the document has blue borders and a gold seal of the state of California. The red Secretary of State seal is present and is generally stamped on the right hand side.

For documents sent to countries who are not members of the Apostille convention, a California Certification will be used.
